This distinction is crucial in defining the scope of liability and responsibility, as parents do not receive payments for driving other families’ kids. The key difference of implementing carpooling vs. providing school transportation is that parents take on the responsibility when offering rides via carpooling to other school families. 

In particular, here are some of the measures we’ve taken to minimize legal risks for schools and districts:

  • Terms of Service Acceptance: Prior to being able to use the Gokid carpool services, all users, like parents and guardians, need to explicitly agree to our Terms of Service. These terms comprehensively cover aspects such as privacy, data security, arbitration for claims, car insurance, and emphasize the importance of using best practice driver safety when driving a carpool. By accepting these terms, drivers acknowledge and agree to the defined responsibilities and limitations of liability, further protecting schools from potential legal claims when parents participate in carpools.
  • Schools are not involved in matching parents or organizing carpools: Gokid Connect is designed to remove the involvement of school staff in pairing families outside of providing the solution. School families, after receiving an invitation to join Gokid Connect, will independently be able to search for potential matches and arrange all details of the carpool without the help or advice of their schools.

  • Contractual Safeguards: When licensing our technology to schools, our contracts clearly define all aspects of usage. For example, in section 14 of the contract, we reinforce our commitment to safety and compliance. We have put in place stringent policies on data handling, privacy, and security practices, ensuring that we do not collect unnecessary information and maintain strict controls over app development and user data.
  • Pre-Opt-Out Option: Gokid Connect will allow families to opt out of the carpool solution at any time after receiving the initial invitation to register. Before getting to this step, schools have the option of running their own opt-out process, which provides an additional layer of consent and opportunity for parents to understand and agree with the terms, particularly those related to liability and safety protocols. When working with schools and districts we offer language to inform parents of the liability matters when carpooling.

  • Technological Safety Features: Beyond the legal framework, our technology incorporates several safeguards to ensure the safest possible carpool services:
    • Volunteer drivers must have their own child as riders in the car. 
    • When a child is opted out, the parent of that child can no longer drive those trips
    • Routes are calculated to have the driving parent end the trip at their own home. 
    • The assigned driver and riders of carpools will receive reminders and notifications of pick up and drop offs. 
    • Live tracking of the vehicles during the trips.
